1. Acceptance of Terms

By accessing or using Climateshed Intelligence (the "Service") — including via the web interface or iOS app — you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Nature of the Service

Climateshed Intelligence is an AI-powered information service that retrieves and synthesizes content from a corpus of California climate-related documents. The Service is provided for general informational and research purposes only.

The Service does not provide:

• Professional, legal, regulatory, engineering, or scientific advice
• Official guidance from any government agency or regulatory body
• Site-specific risk assessments or hazard determinations
• Investment, insurance, or financial advice

Nothing in any response generated by the Service should be construed as a substitute for consultation with a qualified professional.

3. AI-Generated Content Disclaimer

Responses are generated by artificial intelligence and retrieved from source documents. Despite referencing source materials, the Service may:

• Produce inaccurate, incomplete, or misleading information
• Fail to reflect the most current data, regulations, or scientific consensus
• Misinterpret, misattribute, or misquote source documents
• Omit relevant information present in the source corpus

You are solely responsible for independently verifying any information before acting on it. Always consult primary sources and qualified professionals for decisions that may affect health, safety, property, or legal rights.

4. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CLIMATESHED INTELLIGENCE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any information provided will be accurate or reliable.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CLIMATESHED INTELLIGENCE AND ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Reliance on any AI-generated response or cited information
• Decisions made based on Service outputs
• Loss of data, revenue, profits, or business opportunities
• Property damage or personal injury
• Service interruptions or errors

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM OR (B) FIFTY DOLLARS (USD $50).

6. Indemnification

You agree to defend, indemnify, and hold harmless Climateshed Intelligence and its owners, operators, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of or access to the Service
• Your reliance on any AI-generated content or information provided by the Service
• Any decisions, actions, or omissions you take based on Service outputs
• Your violation of these Terms
• Your violation of any applicable law, regulation, or third-party right
• Any claim that your use of the Service caused damage to a third party

7. Acceptable Use

You agree not to use the Service to:

• Transmit unlawful, harmful, or abusive content
• Attempt to circumvent quota limits or security controls
• Resell or redistribute Service outputs without authorization
• Interfere with or disrupt the Service or its infrastructure
• Represent AI-generated outputs as official government or regulatory guidance

8. Subscriptions and Billing

Paid subscriptions are billed monthly and may be cancelled at any time via the billing portal. Refunds are not provided for partial months. We reserve the right to modify pricing with 30 days' notice.

9. Modifications to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in California.

11. Client Complaints

We are committed to handling and resolving client complaints fairly, promptly, and transparently. We maintain the following formal process for any complaint relating to the Service, billing, data handling, or content:

• How to submit a complaint — Email feedback@climateshed.app. To help us investigate, please include a description of the issue, the email address associated with your account, relevant dates, and any supporting screenshots.
• Acknowledgement — We acknowledge receipt of every complaint promptly and confirm that it is being reviewed.
• Investigation and resolution — We investigate each complaint and provide a substantive response within a reasonable timeframe. If a complaint is complex and requires additional time, we will keep you informed of our progress and of when you can expect a resolution.
• Records — We keep a record of complaints received, the actions taken, and their resolution. These records support accountability and help us identify and correct recurring issues.

12. Intellectual Property Rights

We respect the intellectual property rights of others and maintain a formal process to ensure that the Service does not infringe the copyrights, trademarks, or other intellectual property rights of third parties:

• Source documents — The Service retrieves and synthesizes content from a corpus consisting primarily of government and other publicly available climate-related documents. We track the source of each ingested document and present responses with citations that attribute information to its original source.
• Software and open-source components — We use third-party software libraries in accordance with their applicable licenses and review our dependencies for license compatibility.
• AI-generated responses — Responses are generated from retrieved excerpts and presented with citations to the underlying sources. The Service is not designed to reproduce substantial portions of copyrighted works verbatim.
• Our marks — "Climateshed" and our related branding are our property. We do not use third-party trademarks in a way that implies endorsement or affiliation.
• Reporting infringement — If you believe that content made available through the Service infringes your intellectual property rights, please notify us at feedback@climateshed.app with (a) identification of the work claimed to be infringed, (b) identification of the material you believe is infringing and where it appears in the Service, (c) your contact information, and (d) a statement of your good-faith belief that the use is not authorized. We review all notices promptly and, where a claim is valid, remove or remediate the material in question.

13. Data & Privacy

We collect and store your email address, conversation history, and usage data to operate the Service. We do not sell your personal data.

Data retention: Your conversation history and account data are retained for the following periods after your last account activity, then automatically deleted:

• Free accounts: 90 days
• Paid accounts (Starter and Pro): 3 years

You may delete individual conversations at any time via the interface. To request deletion of your full account and all associated data before the automatic expiry, contact us at feedback@climateshed.app.
